What is a Fiancé Visa?

According to the U.S. Department of State, a fiancé visa, officially known as a K-1 visa, “… Permits the foreign-citizen fiancé(e) to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival.” This visa is specifically designed to help couples start their lives together in the United States, and offers a limited window in which to do so. Once the non-citizen fiancé(e) arrives, the marriage must take place within a 90-day window after their entry. After the wedding, the next step is typically applying for a green card to adjust their immigration status.

Those wishing to receive a K-1 fiancé visa must meet several criteria to be eligible. For starters, the petitioner must be a U.S. citizen, and both individuals must be legally free to marry. This means any prior marriages must have been legally terminated by divorce, annulment, or death. Additionally, the couple must have met in person at least once within the two years before filing for the visa, unless specific exceptions apply, such as cultural or religious restrictions. Lastly, the relationship must be bona fide, meaning it is genuine and not solely for the purpose of obtaining immigration benefits. 

How to Apply for a Fiancé Visa (K-1 Visa)

Applying for a K-1 fiancé visa can feel complicated, but with the right guidance, you can move through the process more confidently. At Andrade Auld Law, we can help you and your fiancé(e) take the steps needed to begin your future together. 

The application process for the K-1 visa includes the following:

  1. File Form I-129F. Submit Form I-129F to USCIS to establish your relationship and intent to marry within 90 days. 
  2. USCIS review and approval. USCIS reviews the petition and, if approved, forwards it to the National Visa Center (NVC). 
  3. NVC processing. The NVC sends the approved petition to the U.S. Embassy or Consulate in the fiancé(e)’s home country. 
  4. Complete the visa application. The fiancé(e) completes Form DS-160, pays the fee, and submits any required information. 
  5. Gather supporting documents. Both parties collect proof of relationship, identification, and financial support documents. 
  6. Attend the visa interview. The fiancé(e) attends an interview where the visa eligibility is reviewed and decided. 
  7. K-1 visa issuance. If approved, the K-1 visa is issued, allowing travel to the U.S. for marriage within 90 days. 
  8. Marriage and adjustment of status. After marrying, apply to adjust status for permanent residency.
